Explanation of Family Leave at AA and the Presidential Grievances Filed on behalf of the Members of the Association of Professional Flight Attendants

The federal Family and Medical Leave Act (FMLA) requiring certain employers to give employees time off from work for a serious health condition (either for the employee’s condition or the condition of a qualified family member) was enacted in 1993. Prior to that, American Airlines unilaterally implemented its own Family Medical Leave (FML) policy in 1991, which covered most of its employees without specific reference to their eligibility under the prospective statute.

In October 2001, the Company implemented several unilateral changes to its FML policy for Flight Attendants including an eligibility requirement of 720 on-duty hours. APFA filed a Presidential Grievance (aka “FML I”) in December of that same year against AA as a result of these changes to the FML policy.

The FML I Presidential Grievance hearing took place in two different sessions in October and December 2002 before Arbitrator Roberta Golick. An Award was issued on June 30, 2003. In July 2004, APFA filed additional requests with the Arbitrator, resulting in the Union and Company Board members requesting a Remedy Award. This was due to disagreements between APFA and AA as to the Remedy portion of the original FML I Award.

APFA and the Company presented their respective cases regarding the Remedy portion of FML I in 2005 and 2006 (FML I Remedy). The Arbitrator and the Union and Company Board members signed the FML I Remedy Award on July 28, 2006.

In May 2004, the Company announced additional changes to the Flight Attendant FML policy to become effective June 1, 2004. APFA filed another Presidential Grievance protesting the additional changes. This grievance (known as FML II) was submitted to Arbitrator Susan Brown. APFA and the Company presented their respective cases in hearings and briefs in September ’05 and February ‘06. Arbitrator Brown issued an Award on September 1, 2006.

The FML II Award established a 60-day period to revise and implement certain procedures. As a result, APFA and the Company have been meeting together during the month of October 2006 to ensure that the revised procedures are in accordance with the principles outlined in the Award. Flight Attendant Family and Medical Leave Review and/or Appeal procedures will soon be posted on the APFA and the Company’s respective Web sites. Additionally, HI6 messages will be sent to individual Flight Attendants covered under the remedy portion of the Award.

Further, APFA and the Company are also working to identify those Flight Attendants who were affected and are subject to a remedy under FML I following the July 28th FML I Remedy Award. You will be notified individually by the Company if you are subject to the remedy issued under this Award.
