Negotiations Status

Open

Once a party makes its first changes to a Section, the Section is considered open and available to both parties to make changes to the current language. Upon completing the changes one party wishes to make to a Contract Section a proposal is passed at the negotiating table to the other party for review and to make changes of their own or to accept. Once that is done, the proposal(s) are passed back and forth between the parties until an agreement is made.

Tabled

An open section here remains unresolved but is not currently in active negotiations.  Some reasons a section may be tabled include the need to resolve provisions of other sections in order to finalize the tabled section, the need to fill in a value or dollar amount, which is typically done near the end of the negotiations process or the need of one or both parties to do more research on the topic.

Tentative Agreement

The parties have reached an agreement on these sections/provisions.  While not likely, there may be a need to revisit a section that has been previously agreed, which is why it is labeled “tentative”.  Some examples of reasons that might cause a TA’d section to be revisited include subsequent changes in other sections that create a need to make a change in the TA’d section or regulatory or statutory changes that may occur while the parties are in negotiations that drive the need for a change.  Typically, the first sections to receive this designation are those sections in which neither the union nor the company has proposed any changes.

Not Open

All sections of the contract are considered available to both parties at the table. They remain closed until one or both chooses to make a change.
