This is the weekly legislative update for January 31, 2011 from Julie Tandy Frederick of APFA Government Affairs.

Many believe one of the biggest upsets and surprises in the midterm elections was the defeat of longtime friend of labor, James Oberstar D-MN.†Oberstar chaired the powerful Transportation and Infrastructure Committee. In an interesting twist, Oberstarís opponent and now new representative from the Minnesota district is Rep. Chip Craavack R, a former Northwest pilot and Air Line Pilot Association union official. Craavack was just named to the number two position on the majority side of the aviation subcommittee.†The Democrats have appointed Rep. Nick Rahall D-WVA as ranking member on the Transportation and Infrastructure Committee and Rep. Jerry Costello D-IL who will serve as the aviation subcommitteeís ranking member.

A disturbing trend is noted by the FAA in the number of laser devices being aimed at aircraft in 2010. Last year, 2800 incidents were recorded and is double the number from the previous year.†The FAA began tracking laser incidents in 2005.††The highest number reported came from LAX followed by ORD.†The FAA believes the greater availability of lasers on the Internet and increased pilot reporting account for the change.†Aiming lasers at the cockpit can cause temporary blindness and potentially eye damage.†Several states and cities have passed laws against using lasers for uses other than what they are intended. Federal charges can be brought on†individuals for†illegally†aiming lasers†at aircraft.

American Airlines and Priceline have reached a deal to have Priceline†customers use Direct Connect to access Americanís internal reservation system for fare and schedules.†American believes it will be better able to customize offerings without the having to pay booking fees to the global distribution system (GDS).†Orbitz and Expedia pulled American from their booking search engine when AA insisted the two companies use Direct Connect.†For their part Orbitz and Expedia and several consumer groups do not believe it provides passengers the ability to compare prices.

The City of Santa Monica, California has been in a long legal battle with the FAA†over allowing large business jets to use their municipal airport.†In the latest decision, the U.S. Court of Appeals has ruled in favor of the FAA.†The City of Santa Monica had argued that the FAAís decision to allow large business jets into SMO was ìarbitrary and capriciousî.†The Court did not agree and wrote that the City had a contractual obligation with the federal government to make the airport available for use.† In their decision the Court wrote, in part, that the airport was required to make its facility available in ìfair and reasonable terms and without unjust discrimination to all types, kinds, and classes of aircraft.î†Santa Monica can still appeal this decision to the Supreme Court.

American Airlines announced it has entered into a purchase agreement with the Boeing Company under which American will acquire two Boeing 777-300ERs†to support its ìglobal network strategy and to capitalize on international growth opportunitiesî. The two aircraft are expected to be delivered in late 2012. See the PR news release.

While Arizona Congresswoman Gabrielle Giffords D-AZ is recovering†from gunshots wounds she suffered while in her home district, Rep. Jerry Costello D-IL has agreed to fill in for her on the Science Committeeís space and aeronautics subcommittee.† Costello will continue to be the ranking member on the aviation subcommittee under the transportation and Infrastructure Committee.

Will it be a kinder and gentler Congress?†President Obama gave his State of the Union address this week and in so doing, departed from the usual litany of achievements and goals for the coming year. Members of Congress crossed the aisle and sat together, jokingly calling it ìdate nightî. Afterwards, Republicans were quick to criticize the Presidentís speech as short on specifics.† The President took the opportunity to encourage a new civility in the nationís Capitol.†Tommy OíNeill, from OíNeill and Assoc. forwarded an op ed piece from the Washington Post written by Chris Matthews.†In it, Mathews talks about the relationship and friendship between President Ronald Reagan and Speaker Tip OíNeill, two people who were polar opposites in their beliefs regarding the role of government.†He opines that the two men could teach Washington something today.
